遗产转名怎么申请遗嘱认证?

张律师,您好!

若要将财产转移到受益人名下,首先需要获得遗嘱认证 (Grant of Probate)和/或管理授权 (Letter of Administration)。

请问那该如何申请Grant of Probate?

Tan,您好!

为了判断您应该获取遗嘱认证或是遗产管理证书,我们得先知道死者是否立下了遗嘱。

如果死者已经立下了一份合法认证的遗嘱,遗嘱执行人应该申请获取遗嘱认证;反之,如果死者没立下遗嘱,那些对遗产感兴趣的人应该申请获取遗产管理证书。

假设您想要获得遗嘱认证,遗产执行人应该向马来西亚高等法院,提交遗嘱认证申请书和所有必要的文件。其中包括遗嘱原件,死亡证明书原件和一切与死者遗产相关的原件。

倘若高等法院批准此申请,高等法院将释放冻结的资产,并且授权遗嘱执行人执行所有遗嘱上立下的法律义务,比如还清债务、出售或转让房产和将财产分配于受益人。

胥视遗产总价

如果死者没立下遗嘱或者他/她立下的遗嘱无法被合法认证,您可以根据遗产的总价值向法院提交遗产管理证书。

假如遗产的总价(不包括不动产)少于或等于60万令吉,申请书应该提交于公共信托有限公司(Amanah Raya Berhad)。

假设遗产总价(包括不动产)少于200万令吉, 您可以向地区土地管理部门提交申请。

若是遗产的总价值超过200万令吉,您应该向马来西亚高等法院提交申请。

Title Perfection done的单位是指有关房产,发展商已经转名给业主,和有关当局已经颁发个人土地所有权。

我只能评论无论你从那个管道购买产业都好,比如购买全新的房产;购买二手房产或购买金融机构安排的拍卖产业,都有可能会面对种种预测不到的问题和风险,尤其是第一次购买房产业者。

当你决定是否购买金融拍卖产业时,最好多留意拍卖文件的所有条约,如注明金融机构是否承担前业主拖欠发展商的服务费、管理费、维修费、门牌税、地税及其他费用。若金融机构不愿支付有关的拖欠费用,你应先了解有关拖欠的数额。

在购买拍卖产业前,最好先询问银行以你现有的收入还可以申请多少贷款额来购买有关产业,避免在投标过程中,投标超过银行所允许的贷款预算。

土著保留屋 能转地契吗?

我看中一间保留给土著(bumi lot) 的双层排屋,地点好、租金潜力可观,是99年地契。

请问土著房屋的地契可以申请转为普通地契吗?在申请的过程万一失败了,还需要付律师费吗?

整个过程需要多久时间?成功率高吗?

Swee Sang,您好!

土著保留屋一般都不能转卖给非土著,您可以先去土地局(Land Office)询问该房地产的地契状况。

若真的很想要,可以提交“转让同意申请书”,并提供理由说明为什么应该“释放”(release)该地段。

比如说:即使已经打广告和宣传多年,这土著保留屋依旧没有土著购买。

如果申请失败,仍然可以提出上诉。

不过,这过程可能需要长达数年的时间,并且无法保证成功,因为结果将由土地局根据具体情况来判断。

至于律师费用,您必须和您的律师商量。

买拍卖屋前 一定要这么做!

从拍卖市场购买房产,
是否安全?

由于经济放缓,大量的房产正被银行拍卖。通常,拍卖房产的底价是非常有吸引力的。

竞标拍卖的房产,存在着什么风险呢?建议投标者在拍卖前对有关房产进行土地调查。如果所标的房产没有任何产权负担或阻碍,投标者理应可安全投标。

不过,也有情况是前地主将其部分的土地交给政府,但该交易并没有被登记和显示在土地房产调查册里。

在Bayangan Sepadu Sdn Bhd V. Jabatan Pengairan Dan Saliran Negeri Selangor & Ors的案件中, 联邦法院裁定:-

“根据国家土地法,在公开竞标的成功投标者获得了对所标房产的不可废除拥有权,而未登记者的权益,将不受国家土地法的保护。所有未登记的土地房产交易或买卖,都不能否决有登记者的拥有权。”

案情

1)本次上诉的纠纷是关于巴生的一块土地 (“该土地“)。该土地之前是由Newacres Sdn Bhd 和Bumi-Murni Sdn Bhd 共同拥有。

2)于2011年3月25日,该土地在通过巴生土地局所实行的公开竞标,被一名买家用366万令吉购买。由于前屋主拖欠联昌银行(CIMB Bank Berhad ) 的贷款,于是该银行申请上述的公开竞标。

3)于2011年7月,买家则聘请了一名有执照的测量员,对该土地进行检测,结果显示,该土地上有一个蓄水池和其它围绕着蓄水池的永久性建筑物,其则占了17.49英亩里的9.554英亩地段。

4)买家随后则写信给雪兰莪州水利灌溉局(Jabatan Pengairan Dan Saliran Negeri Selangor),要求有关当局提供资料和文件,以证明当局占用土地的正当理由。

5)尽管买家在司法出售之前进行了土地房产调查,但该调查册却没有显示有蓄水池和建筑屋子在该土地上,同时也没有显示该土地的一部分已交回给雪兰莪州政府。

6)于2011年5月4日(公开竞标后),买家在此进行土地房产调查,但依然显示相同的结果。买家之后各别在2016年11月26日和2017年5月11日进行土地房产调查,发现雪州水利灌溉局的权益,并没有在拥有权登记文件中登记,也没有任何将土地交回给雪州政府的记录。

7)雪州水利灌溉局则出示文件,以作为支持当局声称该部分的土地已移交给雪州政府。

8)买家要求雪州水利灌溉局交付空置土地,并拆除围栏和建筑物。由于该局未能遵守买家的要求,买家随后向高等法院提出诉讼。

裁决

联邦法院裁定:

1)当一个人登记为某些土地或土地权益的拥有者, 他或她获得了不可废除的权益,除了在国家土地法第340项所规定的以下情况:

(a) 在欺诈或者虚假陈述的情况下;或者
(b) 伪造或作废的法律文件; 或者
(c) 拥有权或权益是非法获取的。

2)虽然买家没有视察土地现场,但即便买家视察土地现场并发现大部分的土地被蓄水池和建筑物覆盖,调查册上的拥有权(拥有权登记文件),正如买家进行的土地房产调查所显示的一样(无任何产权负担障碍),没有差异。

3)买家已在竞标前后尽了最大的努力,对该土地进行了多次的土地房产调查,查册结果显示,该土地的登记文件上并无任何产权负担障碍。

结论

建议投标者在竞标之前进行土地调查,以便确保该土地没有任何产权负担障碍。

任何未登记的权益,都不能否决成功投标者的拥有权。
