在大马 买到凶宅能退吗?

我看到贵网站一则新闻“刚买房5天 就变凶宅了?”

新闻中报道,在中国有人买了屋子并签署S&P后,屋主却在那屋里错手杀人,而变成凶宅,最后法院判无法撤回合约,但能索赔。

我想请问同样的情况若发生在马来西亚的话,作为新屋主,我们能够取得何种赔偿?

Evon,您好!

如果同样的情况发生在马来西亚,合同是不能撤销的,但或许法庭会应许赔偿。

除非在买卖合约前, 卖家确定房屋没有命案,而之后发现卖家有意隐瞒,那你就有权利撤销合约。

但是,在警方调查封锁期间,新屋主可以要求索偿封锁期间的损失享受的权(“loss of enjoyment of property”)。

此外,新屋主也可以尝试索偿财产贬值的损失。

凶宅试睡员一晚赚千元

看到有人试睡后,
你是否就不抗拒凶宅了呢?

为了让人人唯恐避之不及的“凶宅”能成功销出,最快的方法是消除大家对凶宅的”恐惧“。

因此,有了“试睡员”这份工作!

这并不是空想,而是已经发生的事实!最近,在江苏一间凶宅,因为房主生前赌博欠债而选择烧炭自杀。但在经过试睡直播后,成功以128.5万人民币(约85.54万令吉)成交。

中新经纬访问相关的试睡员,对方解释他的工作就是要展示房屋居住体验,更重要的是让买家打消顾虑,证明凶宅“没毛病”。为此,他拿着手机在凶宅中做直播,还不时和网友对话。

据记者了解,在中国闲鱼等二手交易平台,其实有不少的试睡员应聘内容,有人写着:“全国可接,偏远地区加钱,来回路费雇主报销,主接湖北的单,试睡时间可由雇主指定。”

按分钟收费

网络上流传着一张凶宅试睡主播的招募供稿,写着每分钟工资1人民币,意味着如果24小时不间断直播,1天可拿到1440人民币(约958.53令吉)。

根据记者查访,试睡员都是以分钟收费,如果是经验丰富者,一个晚上能赚上2000人民币(约1331.30令吉)。

有试睡员指出,通常在接单后,信息发布者李林就会前往房主家,完成一些房主要求的工作,比如在某个规定时间内,关灯去检查床底。除了手机,自己不会再带任何装备。

“这一行归根究底,一个是兴趣,另外就是胆子大,有些人就是喜欢这种氛围。”

也不是每个试睡员都需要直播,有一些客户是因为房子“出过事”,就先找人试睡,确认没问题再入住。

地产公司一条龙服务

在采访过程中,记者发现,除了兼职的试睡员,凶宅试睡背后还有包括地产公司在内的专业团队运营。

他们通常会提供一份详细的服务时间表。比如,凌晨12时不开灯去卫生间查看情况;1时勘查床底与各室屋顶与门口、地下室与阳台、走廊上下有无异常;2时不开灯情况下勘查全屋状况;记录各时段异常情况;第二天早上总结异常情况;标记重点危险区域……

地产业者指出,除了凶宅试睡,他们还能帮助房主彻查屋子,比如通过房管局查册、公安局调档案的方式查清楚人是怎么死的’等。

《北京青年报》旗下的北京头条报道,一间凶宅在经过试睡直播后,成功引起大量围观,最后还真的卖出去了! 

所谓凶宅,按照传统观念来说是指发生过非正常死亡事件的房屋,许多人都觉得“触霉头“,不愿意购买。

房产降价后开启第二次拍卖,经过16次延时后,最终以128.5万人民币成交。

报道中指出,江苏省苏州市吴中区法院的法官介绍,这次拍卖的房屋,位于苏州吴江区的房产,房主生前赌博欠下了一些债务,最后选择在自己的房子中烧炭自杀。“

这间房屋本来由逝者的妻儿继承,目前也居住中,但债主起诉到法院,所以才公开拍卖。

在11月9日时,先是举办了“凶宅试睡”直播,目的是为了营造“凶宅不凶”的氛围。

而后隔日开始,这处凶宅在司法拍卖平台公开拍卖,起拍价为120万人民币(约79.71万令吉),相当于市场价的三分之二。

整个拍卖过程有414人设置提醒,5.2万次围观,却始终无人报名参拍。

之后,该房产在降价后于28日开启第二次拍卖,最终以128.5万人民币(约85.36万令吉)成交。

法院工作人员指出,有的法院在处置‘凶宅’时打折力度很大,而这次只是按照正常的拍卖流程进行打折。

无法可审凶宅案

问的,要问得清楚;
答的,要坦白地答!

虽然说我国没有法律定义凶宅,也没有阐明业主需要披露这方面的资料,但在某个程度上,还是有办法设立一个保护网。

首先,买房子时最好委任或通过合法房地产经纪,国内地产经纪(Real Estate Agent,简称REA)公司,或是旗下的地产协调员(Real Estate Negotiator,简称REN)都归大马估值师、估价师、地产经纪及物业管理局(英文BOVAEP)管辖。

这个专业机构有一套执业守则让会员遵守, 2020年的大马地产经纪公司准则(Malaysian Estate Agency Standard)也列出了第5个执业的核心价值。

其中一项,地产经纪有勤勉义务(Duty of Care),也有人称为注意义务或审慎义务。

这里指的是房仲有义务和责任,保障公众在房地产交易中不会受错误、欺诈、失实陈述、隐瞒相关事实和不道德行为的影响。

所以,买家或租客可以向负责协调的房仲,了解房子的过去事故和历史等,房仲有责任和义务坦白相告。

合约增加2附加条款

因为法津上没有定义凶宅,自然无法可依,同时没有特定单位管辖相关凶宅交易纠纷。

法律界人士就建议买家或租客,在买卖合约(Sale and Purchase Agreement)和租房合约(Tenancy Agreement)中增加两个附加条款,作为权益保护网。

建议附加的条款包括失实陈述(Misrepresentation)和违约(Breach of Contract)的陈述和后果,以此来防止原业主或房东隐瞒凶宅事实。

举例,若业主隐瞒房子过去的历史和事故,诱使你签约,即构成失实陈述,那就可被视为违约,合约就自动失效,甚至列入买家或租客若因此蒙损,可向业主追讨之类。

怕买到凶宅?
买房前先查凶宅资料库……

日本和香港都有凶宅资料库,买房子前上网一查就知道自己看上的房子有没有出过事故,甚至是命案种类或年份都一清二楚。

但我国并没有这种资料库,更没有法律定义凶宅或规定业主必须披露讯息;买二手房不小心买到“鬼屋”或凶宅的机率比新建房子更高。

“鬼屋”的话,如果出名的可能还会听闻过,但凶宅,大概只能网搜各媒体报道收集资料来分析。

当然,你也可以到警局去查询,或在那房子的社区向邻里打听,是否收效就要看运气了。

要怎样避免买到凶宅或遭受过重大天灾的房子?房仲揭秘辛,4招学起来,凶宅无所遁形。

1.求售价出奇便宜

同栋公寓,通常市价差不远,排屋的话,如果同款同区,价格也不会相距太远;突然某栋公寓很多急售单位,而且行情相差大,尤其有几间特别便宜,这种很可能就是有问题。

某公寓单位出命案,首先自己身价会跌,同栋单位也会遭殃,同层更让人觉得怕怕,业主自然也急著脱手。

排屋的话,前后左右的单位大概就是最急著出售的单位,其他同排或同一条街的影响,就看各别邻里对凶宅不吉利的看法和程度而定。

2.格局或装潢奇怪

为了掩饰房子出现过的事故,如血渍、火灾等痕迹,业主可能特别施工,大装修或调整房子原本的格局。

如果发现房子某些空间有些突兀的施工,像卧室有奇怪的橱柜,或是厨房浴室位大调动之类,又或是有些壁柜完全被钉死,就更可能是为了掩饰发生过的事故。

3.宗教圣物或辟邪物品

不管是租或买,看房子身临其境,最容易观察前屋主的生活轨迹和房子发生过的大事,比如大水淹过而屋主又没有好好粉饰,柱子和牆上就会留有水迹。

同样,若房子有闹鬼之类的事,可能会找到宗教或辟邪物品,像是房子窗门又或是在某个不寻常的角落,会黏有符咒或已经撕下来的痕迹。

当然,不排除宗教物品是前屋主的宗教信仰相关,但如果量很多,可能就要谨慎看待。

4.大楼改名外观换装

发生重大命案,媒体很可能就会把事发公寓或社区的照片刊登出来,这往往就会影响区内房价。

管理层很可能应业主要求,把大楼换上新名字,又或是在外观上大整修。

尤其是公寓还很新,外牆就换上新颜色或加了比较大而明显的装修,很可能就是公寓发生命案,而发展商手上还有很多单位未售出,为避免新买家认出,赶快出资把整栋公寓外观改头换面来掩饰。

如果你上谷歌搜不出公寓,但地图上同一地点标示的是另一栋公寓名,又或是看谷歌地图街景看到的公寓外形有很大改变,尤其是新公寓,很可能就是发生过事故。

怕买到凶宅二手房?
这个国家的资料可齐全了!

即使不忌讳,相信没有多少人会不介意买到凶宅,尤其是买来自住的投资者。

但在马来西亚,买二手房随时会买到凶宅,主因是我国法律没有定义何为凶宅,政府也没有收集这方面的资料,即使是负责编制我国房地产行情的国家产业资讯中心(NAPIC)也没有这些数据。

要确定想买来自住的房子有没有出过命案,投资者只能靠自己的人脉、或询问邻居、或从媒体的报道收集资料做功课。

在业界,一般会用“污点房产”(英文称Stigmatised Property)来区别传说中的“鬼屋”,又或是发生过命案如自杀或他杀事故的房子。

在日本,凶宅被归纳为“事故物件”(jiko bukken),这裡的物件指的是房子。而“事故物件”也会把让人心理感受不好的因素归纳其中,例如邻居是黑社会老大、附近有色情场所或毒窑等。

“事故物件”在日本是公开的资讯,任何人都可以上日本凶宅网“大岛てる”(https://www.oshimaland.co.jp/)查询;这是买卖或租用房子时,相当重要的工具网站。

网站内的地图有火标记意指事故房子,可搜寻、缩放查看资料。

使用方式很简单,利用缩放地图,上面有火的标记,就表示那是发生过事故的房子,也可以输入房产地址来查询。

里头甚至会标明什么命、死因,还有案发年份;有些地方还会有建筑物或事件的照片。

图中显示该处曾发生暴力冲突被刺杀的事故。

中国和我国一样,官方没有凶宅资讯,于是民间就有人发起创建凶宅大数据平台“凶宅集”,据称已收录12城市共6159间凶宅资料。

隐瞒房子黑材料?赔!

日本法律规定,
瑕疵屋闹鬼房都须申报

房子有缺陷或瑕疵,在马来西亚的认知大概就是房子本身有问题,漏水、白蚁、地砖或地板脱落之类。

在日本,房屋称为物件,出过事故的房子就叫“事故物件” (jiko bukken),如果房子有问题,日本法律上称为房屋有“瑕疵”。

同时,房子如果有瑕疵,业主有必要公开,要是房子出租的话,必须阐明在租约上。

瑕疵也分两种,一是物理上的瑕疵,就是上面所提那些手摸得著眼看得到的东西。

根据日本房仲博客“小僧带路”指出,另一种归为心理上的瑕疵,指的是房子内发生过事故,例如发生过自杀或凶杀命案,也就是我们一般的凶宅。

除了真正发生命案,在日本,即使是都市传说,例如说房子闹鬼、旁边就住著黑帮老大…等等会造成心理压力的房子,都可归类为“心理瑕疵”房子。

法律虽然没有明文规定或定义心理上的瑕疵,但一般广泛的认知有约4种:

1.房屋内有“自杀”或“杀人”。

2.因为事件或事故而在房间内发生死亡(车子撞进家裡)。

3.火灾、天灾等等案件。

4.附近有嫌恶设施(坟墓、工厂、黑道的事务所等…)。

他在博文说,房子有问题,业主有告知义务及责任;根据日本的不动产交易法律里有所谓的“瑕疵担保责任”,简单来说,如果签约时卖方没有明确说明,买家之可以解除合约,甚至是索赔。

这保障也不是非常严密,因为法律没有明确规定需要告知的年限,披露凶宅只有公认的法定年限,租屋3年,买卖5年,以命案发生年份算起。

就是租房子的话,业主需要披露过去3年内是否发生过事故,出售的话就以5年为基准。

但是,业主只需要告知事故发生后,第二手承租或买下单位的人,但却不需要再转告下下手。

也因为这样,很多业主会借用亲友的名字先“租”下事故房子,之后办手续退租,过度一段时间才再转租给另一人,以此来避开披露事故的规定。

230万买到凶宅,法官醤判……

230万买到“凶宅”,
怎办?

调解无效的话就带上法庭?你觉得法庭会怎么判?

中国广州市白云区人民法院,数月前就处理过一单凶宅交易的案件。

原告蒋某经房仲介绍,向被告张某购买区内一间房子,《房屋买卖合同》约定房屋价格363万元(约230万令吉),蒋某承担中介费。

双方签约第二天,蒋支付了20万元(约13万令吉)定金给原业主和中介费6万元(约4万令吉)后,发现有关房子曾发生凶杀案,要求解约并退还支付的款项。

卖家张某不肯,表示发生命案的是隔壁的201房,而买的房子是独栋,同时声称过程中并没有隐瞒,有让房仲告知,不存在不实陈述,而且房子本身并没有瑕疵。

买家要求退款,张某坚持对方知情反悔,不肯让步,要没收定金,于是最终闹上法庭。

物质量不符合质量要求

根据中国《每日经济新闻》报道,法院调取刑事案件档案显示,涉案房子的隔壁201房,在2013年发生过凶杀案,案发时涉案房屋与201房是打通成一套六室两厅的房子。

虽然凶杀案发生在201房,而目前出售的单位已经恢复原有的间隔,但法官认为这不能否定单位出过重大刑事案。

原告以房屋存有质量瑕疵,要求解除《房屋买卖合同》的部份,法庭认为质量瑕疵除了指房子建筑和装潢等客观质量,也要概括房子是否便于生活居住使用等交易价值。

但华人社会传统习俗追求喜庆吉祥、忌讳死亡,所以根据传统民风民俗及公众一般心理,市场比较抗拒发生过非正常死亡的凶宅。

加上根据民法典相关规定,涉案房屋发生过非正常死亡的重大刑事案件,法庭认为这属于物质量不符合质量要求。

法庭最终判原告可要求解除合约,被告必须归还定金20万元(约13万令吉)给原告,并赔偿中介费损失6万元(约4万令吉)。

有关房子原本的业主张某不服判决,之后提出上诉,但在广州市中院二审判决,驳回上诉,维持原判。

凶宅更好赚 他投资200间

只要冲破恐惧,
凶宅投资也是商机。

绝大多数东方人不会愿意买或住凶宅,但在不少东方国家,却有一批批勇敢的投资者,专门投资凶宅。

例如中国各大城市、香港、台湾和日本等地,因为楼价飞升太快,租金非常可观,凶宅投资越来普遍。

在台湾,甚至就有命案现场清洁师,专做凶宅房仲或自己投资,开发出上下游兼顾的新兴产业链。

凶宅投资利润丰厚

谈凶宅投资,不得不谈香港的伍冠流这位另类投资者;人称 “凶宅大王”,伍哥曾投资超过200单位。

综合各传媒採访他的报道,他认为“只要冲破恐惧,凶宅投资利润相当丰厚,是个值得投资的商机。”

抢到贵差价仅10%

伍冠流之前上香港无綫(TVB)节目《我要做业主》,分享多年来的另类投资心得称,投资过200间凶宅,大多数都赚钱离场。

但他也慨叹近年供应断层,凶宅都被抢贵,相比同类型物业只差10%至30%差价。

“早20年前起码有7折,有时6折甚至5折都买到。”难道买家都不怕鬼吗?他笑称,折扣大就克服到恐惧,于是就会买。

他说,现在不介意凶宅的人多了,有时价格只略低10%。

是的,凶宅价格相对同区类似单位更便宜,这些投资者买来纯投资,又不是自己住。

房子改头换面后,在大都会如香港、上海、北京、东京等很容易就找到外国籍租客,要是在香港,不少也会改装成劏房出租,回报相当可观。

阿里拍卖凶宅好卖

有些成交价比底价或是估价高,
投资者的热情丝毫没被“凶”到!

房地产行情热络的市场,凶宅往往成为热门的另类投资选择,而且回报并不低,甚至比“干净”的房子回酬更高。

别人眼中可怕的凶宅,在勇敢投资者眼中,却是最有利的生财工具,趋之若鹜。

阿里拍卖纪录中,就多次看到凶宅出现热烈竞标,有者成交价甚至比底价或是估价更高,投资者的热情丝毫没有被“凶”到!

据凤凰网房产报道,去年8月,合肥市滁州路1号教师新村(东区)一座曾发生碎尸案的凶宅,在阿里拍卖上经历了28次延时,最终以86.43万人民币(约55.9万令吉)成交。

这个成交价比起拍价55.93万人民币(约36.2万令吉)高出30多万人民币(约19万令吉),甚至比79.9万人民币(约51.9万令吉)的评估价还高!

杭州丁桥景园著名的凶宅,和估价相同成交。

另外,钱江晚报去年7月14日报道,杭州丁桥景园一间面积93.4平米的著名凶宅,经历了52次举牌,43次延时,在14人争抢中,终于以222.14万人民币(约143.7万令吉),和估价相同成交。

曾发生碎尸案的南京市瑞景文华小区一栋3层别墅,高出起拍价售出。

据中国江苏网,2018年7月,南京市瑞景文华小区一栋发生过碎尸案的3层别墅,竞标后以786万人民币(约508.5万令吉)成交,高出起拍价351万元(约227万令吉)。

买家是谁?

到底这些人为何不介意买凶宅?他们真的买来住?钱江晚报分析称,通常买凶宅的人主要有三类:

  1. 想借钱的人

凶宅成交价一般比市价低,但银行估价还是会向市场价看齐,买家有可能借到高过实际成交价的贷款额。但是,不同城市的房贷情况可能不一,因为一些城市会要求也就是成交价、评估价和网签价相同,银行就会根据买卖合约的标价批放贷款。

  1. 转售赚差价

买家可能不是买来自住,而是真正的投资者,像“香港凶宅大王”伍冠流那样,买了凶宅,再经过改装转售,赚取买卖差价。

  1. 买来自住

也有不少买凶宅的人是买来自住,尤其在一二线城市,房价居高不下,凶宅价格往往会在原基础上打20%到40%折扣,对资金有限的购房者来说,吉利或风水的因素,远远不及买到一间便宜房子更重要。
