屋主/房东和租客在签订租赁协议
时常犯的错误是什么?

出租房子或房间,如何找到准时交租金和照顾好单位的好租户 ,是每个屋主共同的期许。

租户或租客则莫不期望遇到好屋主或房东,租约过程顺顺利利,没有发生争议。

然而,租户和屋主之间的纠纷总是屡见不鲜,似乎也难以完全避免,问题出在哪里?该如何找到一个理想的解决方案?

对本身是屋主的房屋租赁平台Rumah-i联合创办人陈川会来说,如何避免或减少租房的纠纷,关键在于屋主和租户双方是否有建立互信,以及双方是否有签署一份对彼此都公平的租约,并遵守合约条款。

他指出,出租市场是个人为主,一般上,屋主和租户都对彼此很陌生,能否建立互信就很重要,双方要以诚相待,才能皆大欢喜。

“我认为屋主须秉持8字原则:己所不欲,勿施于人。如果屋主在对待出租的单位上,可以好像自住的房屋那样,这就是成功的屋主和租户关系。”

但口说无凭,要如何取信于人,建立信任,总要有一些依据,所以个人信用记录就显得格外的重要。

以Rumah-i租赁平台为例,它是一个独立的平台,可以作为屋主和租户之间的一个桥梁,让彼此建立联系和信任。

它所做的就是建立一个信用体系,包括用户的信用风险评估、屋主和租户对对方的评价,以及租金记录等等,这些信息让双方了解对方,并产生信任。

租赁纪录评估风险

那么,该如何对租户进行信用风险评估?

陈川会说,该平台与信用评估机构合作,由后者提供租户在中央信贷咨询资料系统(CCRIS)和信贷服务情报有限公司(CTOS)报告的纪录。从中可以知道,如果租户的信用风险系数高,还款能力就比较弱,反之亦然。这是其中一个可以提供给业主考虑的因素。

与此同时,每当通过该平台促成的一个租约结束时,屋主和租户双方都可在平台上给对方评价,到底对租户而言,有关房屋的住宿环境如何,而对屋主来说,则是租户在租用有关房屋或房间期间的品行如何。

有关信用评估报告纪录相当完善,包含租户在银行的所有贷款纪录,包括汽车贷款、信用卡交易纪录,甚至电话账单、Unifi账单等。

“我们也有租客付还租金的纪录,每个新的屋主都可以看到这些纪录,来衡量有关租户的还款纪录是否良好,才决定是否要出租屋子或房间给对方。

“若遇到一些租户迟还租金,我们会把迟还租金的租户名单呈报到平台,对他们的影响就是日后跟银行申请贷款会面对一定的困难,可以帮屋主追查租户的还租金纪录。”

信用评估双刃剑

他坦言,信用评估其实是双刃剑,有好有坏,但好处会比较多 。

毕竟我们是要提倡一个讲求信用的社会,如果租户的记录不好,就需设法改善。

他说,如果租户有心要租,当然要让屋主知道其过往纪录,不然口说无凭,要如何建立信任?

他指本地租赁市场还很原始,供应和需求都是个人提供,屋主和租户的素质都参差不齐,住宿的环境不是很理想。

“所以我们2019年成立Rumah-i时的想法就是要提供一站式服务的平台,以提高整个租赁市场的素质,并尽量把线下完成的租赁程序都搬到线上,把所有程序整合到一个平台上,通过一个平台解决整个房屋租赁的所有事宜,这会对租赁市场带来改变。”

租户多没捍卫权益

虽说现有法律更有利于租户,但很多时候,大部分租户都没有或不懂得行使法律上赋予他们的权益。这主要可归纳2大主因。第一,他们根本不知道,第二是他们觉得很麻烦。

陈川会指出,尤其是只租房间的租户,很多都是大专院校学生或刚毕业的社会新鲜人,他们大部分都不懂自己在这方面的权益,所以我们作为平台,有必要通过标准租约来保护他们。

“所以我个人认为,房东在这方面占据更大的主动权。为了有效的解决任何纠纷,租赁合约的条款就显得非常重要。”

例如在目前的房屋租赁市场,尤其是房间出租,有相当多的租户没有签署任何合约,但双方其实有必要了解签署合约的重要性,而且必须盖章。

电子租约保障双方

“Rumah-i 在租赁合约方面也有下工夫,将租赁合约电子化、标准化。简单来说,Rumah-i会提供一份标准的租赁合约,屋主和租户双方在Rumah-i的应用程式上签约,之后Rumah-i会拿这份合约去盖章。好处就是公平、方便又环保。”

陈川会解释,当初该平台会推出租赁合约,也是想到很多租房的租户和屋主双方都没有签署任何合约,并发生很多纠纷,而且对双方没有什么保障。

“我们的标准电子租赁合约是委任律师楼草拟的,当初也有比较过市面上各类租赁合约,而选择当前的标准合约细则,而且不会偏向屋主或租户的任何一方。”

随意过目就签租约

屋主/房东和租客在签订租赁协议时常犯的错误是什么?大家常有的迷思包括哪些?

陈川会指出,一般上,很多人都是随意过目租约就签署,其实这等同于轻易放弃自己的权益。如果可以的话,租户事前要求屋主先提供合约,让自己先过目,面对不合理的条款,就要求修改。

“像Rumah-i提供的电子合约,双方都可以在签约前先下载,绝对有充分的时间审阅,若其中一方觉得有不合理的条款,都可先做修改,再签署合约。”

拒上法庭宁“私了”

另一方面,在发生纠纷时,很多屋主和租户认为法律途径不是最好的选择,很多时候都选择私下解决。

“也许这是最快的方法,但却不是最恰当的方式。因为最终的结果都是偏向如何诠释。“作为租赁平台,我们时刻都强调签署租赁合约的重要性,并简化签署合约的程序,让市场知道,签署合约是必要的。”

线上签名不需要见面,只是必须先确认双方的身分,才进入签署电子合约的程序。

“我们的平台就是免费让屋主使用,通过平台找到租户后,双方其实不需要见面,就在满意对方条件的情况下在平台上签署电子合约,处理和解决整个出租房屋或房间的流程。

“在平台上出租的房间都有一个电子锁,如果屋主已接受某个租户,不必与租户见面,只需直接告诉对方房间电子锁的密码,租户即可使用有关房间。”

租户可以平台缴付租金,我们的系统就自动转账到屋主的银行户头。至于水电费,租户则必须自行缴费给水供公司和国能公司,而无法通过这个平台进行。

曹建益:减少双方误会

在房屋租赁管理方面有8年经验的Rumah-i联合创办人曹建益说,屋主一般担心收不到租金、屋子欠水电费、屋子或房间遭到破坏等问题;租户则一般上担心屋子坏了,屋主没理会,屋主乱起租金等。

“我们的角色就是减少屋主和租户之间的误会和摩擦,就好像“润滑油”那样。

“我们会先审查租户的个人资料和背景,除了信用评估,就是他们的工作、收入等。”

即使一名租户不曾购屋,没有房屋贷款记录,Rumah-i也可通过CCRIS或CTOS的报告,了解他们的财务状况,例如信用卡还账记录等。

如果租户完全没有任何银行的交易记录,租赁平台就必须自行询问租户有关财务上的资料,例如知道租户在哪里上班,以减少拖欠租金等问题。

曹建益坦言,除了一些租户纪录欠佳,其实也是有不好的屋主,所以我们平台也会给予屋主一些忠告,协助改善屋主和租户 之间的关系。

“当双方发生纠纷,如果是普通的争议,我们可以帮忙解决。我们也会审查租户还水费和电费的记录。

“纪录不好的租户,可能无法租到租金较高的屋子或房间。”

减少租赁纠纷3妙招
1.准备一份完整清单

完整的清单对于提供屋主/房东财产的书面纪录至关重要。这可以保护双方在盗窃或损坏的情况下,和/或在租约结束时免受虚假索赔。

清单应详细并针对每个生活空间进行细分。它应包括:

●餐桌、床、椅子、沙发、电视、音响设备、冰箱、冷气机等家用电器和硬质家具;

●家居装饰,如百叶窗、窗帘、床单、床垫保护套和椅套;

●装饰品,包括墙壁艺术、盆栽和装饰品;

●永久性固定装置,例如风扇和灯;以及

●水表和电表读数。

详细记录所有家用电器的品牌和型号,避免大屏幕电视、洗衣机等高价值物品被类似但劣质的产品替代。如果发生电气故障,房东应掌握必要的详细信息,以方便快速检查和维修。

屋主或其指定的代理也应在签订租赁协议当天检查所有电器,确保它们处于良好的状态。

2. 拍照

很少人会拍下出租单位内的家具和摆设等的照片,但这其实可作为日后双方发生任何纠纷的“呈堂证供”。

屋主和租户可各自保存上述清单、照片和租赁协议的副本,以供相互参考。

一些单位可能会“按原样”出租,存在划痕和损坏,因此务必在移交前附上地板、墙壁和天花板的照片,以突出显示任何预先存在的缺陷。

即使出租单位没有任何瑕疵,照片也消除了对单位初始状况的所有怀疑。

由于双方都可以获得可接受的证据,房东不能不公平地扣除租户的押金。因此,逐一拍下屋内所有物品可能很麻烦,但有助于减少争议或纠纷。

3. 拟订护理清单

为防止损坏或故障,需要定期维护和保养。任务通常由租户和屋主分担,维护清单有助于清楚地概述每一方的责任。

租户的责任可能包括每半年维修一次冷气机,维护所有电器的状况,以及清理厕所和厨房的排水系统,以避免堵塞。

屋主通常负责较大的物件,例如修理出租单位内的家用电器,除非这些问题是由于租户的疏忽而引起的。

签署的维护清单清楚地定义了租客和屋主所认可的责任。在最坏的情况下,双方都可以参考它来缓和纠纷,提供解决方案并确保他们的权益获得维护。
