“谁说槟城管制短租伤旅游业?”

看起来对一些业者来说,
监管短租才是上上策。

槟州政府从开始宣布要管制短期出租住宿(STRA)以来,一直引起爱彼迎(Airbnb)的关注。日前该公司更发出文告指出,对槟州政府的草拟建议感到担忧,认为这回影响槟城旅游业复苏。

不过,马来西亚商务酒店协会(MyHBA)发文告反击爱彼迎,大赞槟州政府的举措正确且保护旅游业所有业者,爱彼迎不应为了没有受法律规范的商业而发表误导性的言论。

爱彼迎东南亚、印度、香港和台湾公共政策总监吴湘仪日前透露,槟城房屋与地方政府部委员会主席佳日星在7月底的一项会议中建议,联合管理机构(JMB)允许每周只能经营3个晚上或1年180个晚上。

同时,建议即便是商业地契的建筑物,也必须在年会上获得75%的出席业主同意,才能进行STRA活动。吴湘仪认为,这不利国内外游客、影响槟城竞争力和旅游业的复苏。

未受监管/未经许可的非法生意

MyBHA全国主席甘尼斯发文告指出,支持州政府推出STRA管制机制,这将直接提振槟州的酒店和旅游业复苏,同时增加政府的税收。

对于爱彼迎的发言,他代表该协会要求对方不要为了未受监管或无牌经营商业活动的利益和生存,而误导任何一方。

“我们不同意且要驳斥(爱彼迎)的主张,因为我们知道通过STRA住宿生意,是没有受到法律或法规的规范的,而未经许可的生意,就是非法生意。”

马来西亚商务酒店协会(MyHBA)发文告反击爱彼迎,大赞槟州政府的举措正确且保护旅游业所有业者。

出台政策能真正保护各界

他指出,针对STRA制定法规,将能保护旅游和酒店业务,并不会让槟城看起来缺乏吸引力,反而展现我国拥有能保护所有各方的法律和规则,从消费者、游客到酒店经营者、当地旅行社等。

“我们还想呼吁所有州政府,都能主动在各州规范STRA。”

“入侵“酒店业的技术

甘尼斯补充说,各界都应该支持经许可且受法律约束的商业活动,并反对任何会损害酒店和旅游业形象的无牌或非法生意。

“我们形容STRA是一种侵入酒店和旅游业的新常态技术,而管制STRA能带来公平的商业理念,确保酒店业不会被未经政府执法或监管的技术入侵。”

“合理的收入和盈利,将能帮助酒店业者提供更好的迎宾和旅游服务,并帮助政府收取更高的税收,转而投入在改善旅游业的形象。”

槟州政府计划出手管制该州的短期出租住宿(STRA),如今已有草拟的建议,但却引起爱彼迎(Airbnb)的担忧。

爱彼迎东南亚、印度、香港和台湾公共政策总监吴湘仪在文告中指出,槟城房屋与地方政府部委员会主席佳日星在7月28日召开了一项公开对话,爱彼迎和其房东社区成员也参与其中提供意见。

佳日星向当地联合管理机构(JMB)建议,对STRA活动实施上限,即每周只能经营3个晚上,或1年180个晚上。同时,建议即便是商业地契的建筑物,也必须在年会上获得75%的出席业主同意,才能进行STRA活动。

对STRA活动实施上限,引起爱彼迎(Airbnb)的担忧,或影响槟城旅游业复苏。

应由JMB和业主设家规

对此吴湘仪认为,这不利于在槟城探索旅游的国内外游客们,且会间接影响槟城的竞争力,并让大马人难以创造收入,以及影响槟城的旅游业复苏。

她表示,爱彼迎呼吁佳日星允许商业地契建筑物继续进行STRA活动,由JMB和业主们来制定STRA活动的相关条规。

“州政府所设立的STRA条规应该是鼓励旅游业,而非限制槟城的旅游活动。我们强烈相信STRA能够、且应以公平和平衡的方式监管,让所有持份者都能从中受益。”

槟州政府之前表示会针对短租活动拟定相关的管制指南,如果民宿是属于商业地契且合法经营,不会受到干预;而一般住宅的话,则会胥视附近居民投诉游客或租户干扰问题,加以管制,还居民安宁生活。

Airbnb出“派对禁令”!

在Airbnb租个房搞个派对?
对不起,你永远不能这么做!

两年前,旅行房屋租赁平台爱彼迎(Airbnb)对“举办派对”实施暂时限制,如今这个禁令变成“永久性”,且全球适用!

爱彼迎发出公告,将永久禁止“破坏性派对和活动“,包括公开邀请的聚会。同时,只需一晚的一场大型活动所要的”派对屋“(Party Houses),也被禁止。

爱彼迎在文告中指出,建立信任和维护社区安全是爱彼迎社区发展的重中之重。在全球范围内,有超过73%的房源已经在“房源守则”中明确禁止派对活动,绝大部分房客也都能遵守这些规定。

加上考虑到冠病疫情,爱彼迎有必要维护公共健康利益,提倡保持社交距离,因此决定实施这项针对全球范围的“派对禁令”,这包括:

  • 在所有未来预订中全面禁止派对活动。
  • 单个爱彼迎房源的最大待客容量限定为16人。这主要是针对一些面积较大可以接待较多人数的房源而进行的规定。
  • 针对一些特殊的房源类型和精品酒店,正在探讨政策豁免的潜在可能性。
碰上疫情,爱彼迎在全球范围暂时禁止所有房源举办派对。

曾发生枪击案5人死

过去,爱彼迎曾经允许房东可以根据房源和周围社区情况,自主决定是否允许房客举办包括生日派对在内的一些小型派对活动。

但在2019年因为一起枪击事件导致5人死亡后,爱彼迎开始禁止“派对屋”,并推出了几项安全功能。隔年碰上疫情,爱彼迎在全球范围暂时禁止所有房源举办派对。

事实上,Airbnb和VRBO等短租平台,这几年一直在和“派对屋”和大型活动“斗争”。

有时,爱彼迎还是未能阻止“派对”的举行。例如,房主不在时,客人可以自己入住偏远的酒店,并邀请尽可能多的人过来

对此,爱彼迎表示,试图违反其规则的客人,将面临从账户被吊销,到完全从平台上删除的各种后果。

2021年,曾有超过6600名客人因违反“派对”禁令而被暂停使用爱彼迎。

爱彼迎退出中国!

若你是爱彼迎的支持者,
下次去中国就要另找其他住宿方式了。

爱彼迎(Airbnb)宣布,由于冠病疫情持续反复,爱彼迎中国将“固本培元”,聚焦出境游业务,同时暂停支持境内游房源、体验及相关预定。

该公司在声明中表示,中国人口数量占到全球总人口数的五分之一,是爱彼迎缔造全球网络不可或缺的一部分。自2016年以来,有超过2500万人次在中国住进爱彼迎民宿。

“然而,疫情持续反复,打乱了旅游业原本的发展步伐,也弱化了境内游业务与出境游业务的协同效应,境内游业务相应地面临高成本等运营挑战。”

但爱彼迎相信,随着出入境政策逐步开放、全球疫情有效控制时,中国旅游者的出境游需求就会全面释放。

“虽然目前亚太地区跨境游业务尚未恢复至2019年水平,但我们相信在未来五年内,亚太地区将成长为爱彼迎在全球范围内的最重要蓝海市场之一,而中国必将成为亚太地区跨境游复苏和繁荣的坚强基石。”

仅占总收入1%

有分析称,此次爱彼迎考虑叫停中国境内住宿业务,一方面是因为疫情下国内出行市场活跃度大幅降低,带来了中长期需求预期调整;另一方面,也与国内民宿市场的多渠道和激烈竞争有很大关系。

在爱彼迎发布声明前,美国CNBC已经引述两位知情人士消息报道,爱彼迎近年来在中国的境内生意,仅占其总收入约1%左右。在中国本土,有近15万个房源。

Airbnb是在2015年进军中国市场,两年后在上海宣布官方中文名为爱彼迎,并和阿里、腾讯等互联网巨头合作,接入移动支付功能,拓展获客渠道。

槟城Airbnb房东 忧禁短租

到底应不应该开放短租?

槟州政府近来打算出手管制州内的短期出租住宿(STRA),爱彼迎(Airbnb)对此表态支持,认为州政府并非全面禁止而是选择监管,是朝着正确的方向迈出一步。

不过,Airbnb也收到一些槟城的业主反馈,呼吁政府不要禁止高楼住宅作短租。

爱彼迎东南亚、印度、香港和台湾公共政策总监吴湘仪发文告指出,对于当局最初建议对高层住宅短租施加极其繁琐的限制深感担忧,数名爱彼迎房东深感担忧,认为这不仅有损他们生计,还会影响当地商业和社区。

因此,爱彼迎呼吁政府重新考虑,勿直接禁止高楼住宅作短租用途,而是让居民自行通过分层管理法令(Strata Management Act),来决定他们的公寓是否允许经营短租。

愿与州政府合作

吴湘仪同时也强调,爱彼迎向来支持公平合理的监管,并与全球各地的政府合作,实施明确和考虑周详的规则,致力通过共享住宿为当地社区和经济带来利益,同时确保负面的外部问题获得圆满解决。

“我们与马来西亚生产力机构紧密合作,通过公众咨询分享行业对国家短期出租住宿指南的意见,并期待能与槟州政府建立同样的合作关系。”

“制定能为住客、房东、当地社区和槟城旅游经济带来积极成果的规则是非常重要的。在目前情况下,在各造利益之间取得平衡,同时推动经济复苏以及未来的永续增长是刻不容缓的。”

近来槟州当地热烈讨论的其中一个话题,就是到底要不要禁止公寓等的高楼住宅,作为民宿,正反两派声音皆在争论。

而掌管槟州旅游与创意经济事务的行政议员杨顺兴透露,州行政议会还在讨论相关细节,因为这涉及很多单位,不仅仅是旅游部,还有房屋部。

他指出,一些国家已经出台相关条规管制短租,槟州行政议会很快就会拟定相关的管制指南。

他进一步解释,如果民宿是属于商业地契且合法经营,不会受到干预;而一般住宅的话,则会胥视附近居民投诉游客或租户干扰问题,加以管制,还居民安宁生活。

酒店还得缴税

而且,将高楼住宅出租作为民宿,对于商业地契的酒店来说不公平,住宅单位只是作为民宅用途,但酒店业者还需要依法缴付酒店税、旅游税,并面对民宅转民宿的“抢滩”。

强制住客登记 防公寓非法民宿

公寓非法经营民宿,
租户赚钱,业主坐牢!

许多在高楼拥有住宅单位,却没有自己入住的业主,往往会考虑将有关产业出租,或转由代理改为民宿来经营。这对于许多本身入住高楼的业主来说,往往是他们最难以忍受的事情。

这两批人的利益往往是相冲突的,完全没有办法平衡。有关民宿经营者为了争取主导权,多数会通过共管机构或管理机构召开的常年大会或特别大会,赢得管理委员会的控制权,以让这些民宿单位能长期经营下去。

事实上,不管这幢高楼是批准作为住宿或商业用途,民宿其实不属于住宿或商业单位。

根据我国现有的法律或指南,旅游部其实只允许乡区设有民宿,而且民宿须由至少10间村宅所组成,才能取得旅游部所发出的认证。

这意味着,所有不属于这个标准的住宅单位,一律不能转作民宿。

不管是称为Homestay或是AirBnB,没有任何政府部门或单位能发出执照,让这些民宿经营下去。

换句话说,所有在高楼内充作民宿的住宅或商业单位,根本就没有办法取得合法经营的地位。

在这情况下,在法律上,所有设在高楼单位内的民宿皆属于非法,而管理层除了援引管理条例执法外,另一个管道就是请地方政府来执法。这包括发出相关通告予业主,要求业主停止有关单位继续充作民宿,同时发出罚单予业主,甚至还可以将业主控上法庭。

其实,绝大多数业主皆以为本身的单位是租给他人入住,等到他们接到地方议会所发出的通告及罚单后,他们才知道这些所谓的租户,其实是大量跟不同的业主签下租约,并在业主不知情的情况下,转以民宿来赚钱。

出租应常探视

然而,地方政府有权在不知谁是经营者的情况下,直接对业主采取行动。

虽然罚款可能只有两三百令吉,但若这些罚款长期未缴付,地方政府甚至可以将这些业主控上法庭。

如果碰到法官严厉执法的话,他甚至可以判业主坐牢,结果是租客赚钱,业主反而要坐牢。

我要在这里奉劝所有业主,要经常去探视本身早已租了出去的单位,并确保租户没有将其转为民宿或其他非法用途。

一旦有任何新发现,业主应该马上采取行动终止这些租约,免得最后搞到自己赔了夫人又折兵。

搜证困难鲜少执法

其实,国内许多地方政府鲜少对这类非法民宿采取行动,这是因为他们在执法时面对许多难题,尤其是采集证据时有许多难度。再者,地方政府也无法派人在这些高楼驻守,长期对违法的民宿业者采取行动。

首先,有一些民宿业者没有商业注册,或者他们所注册的商业名字根本就不存在。他们有者甚至连收据都发不出来,即使地方政府执法人员摸上门,他们也选择躲在屋内,且不开门,这让地方政府要采集所需的证据确实很困难。

管理层可强制住客登记

在这种情况下,高楼管理层其实可以通过跟地方政府配合,通过管理层所采集到的证据,将这些证据交给地方政府来发通告及罚单。这又要怎样做呢?

管理层可以强制规定每个民宿住客必须登记。如果一批人有5个人,包括3个大人及两个小孩,管理层其实可以规定每个人皆须登记,而这些所登记的资料则包括他们的全名、身分证或国际护照号码、地址或来自哪一些国家,还有电话号码等。

只要长期登记每名民宿住客的资料,我们就可以根据这些所掌握的资料,判定哪一些单位涉及民宿生意,然后将这些资料交给地方政府来采取进一步的行动。地方政府可以根据管理层所提供的业主资料,直接对这些业主采取行动。

一旦业主接到地方政府所发出的通告与罚单之后,他们就会跟地方政府了解进一步的情况,进而要求租户给予合理的解释,再不然就提早跟租户解除合约,以避免这些民宿长期非法地经营下去。

条规不明绑手绑脚

环顾2015年分层管理(维修与管理)条例第3附表,由联邦政府统一制订的管理条规(By-Laws),当局并没有针对如何管制民宿有任何规定,管理层或保安人员要直接采取行动对付民宿,往往会面对绑手绑脚的情况。

对于我所接手管理的高楼产业,我往往会建议管理委员会通过召开常年大会或特别大会,并给予21天的大会通告来制订附加管理条规,而这些所要制订的附加管理条例,必须在大会上取得75%业主支持通过,才能取得执法的效用。

严格监督违者开罚

要如何制订附加条规呢?这当然包括授权给管理层或保安人员,可以针对所有要入住的外来者,登记基本资料、检查身分文件,甚至必要时将那些未登记者赶出去,或是取消所有被发现属于民宿住客、甚至是违反防疫标准作业程序(SOP)者的入住或访客权利。

与此同时,一旦被发现任何业主的单位涉及民宿生意,管理层可以针对每一次事故向业主开出罚单。当然,罚款的顶额不得超过200令吉。长期下去,业主在无法招架的情况下,就会选择提早和租户解约,同时将本身的单位租予长期性质的租户。

如果在某幢高楼有逾半业主或单位牵涉民宿生意,即使管理层要通过制订附加管理条例来阻遏这些非法民宿,岂不是会碰钉吗?

如果阻止民宿需要获得出席大会超过75%的业主同意,才能制订附加管理条例,我们如果反过来调整这些附加管理条例的内容,让这些要经营民宿的业主无法取得75%的业主所认同,只要不支持的一方拥有至少25%以上的业主所支持,对方就始终无可奈何了。

因此,要管制或对付非法民宿,只要管理层动一动脑筋,规定民宿住客一定要登记,并监督他们在高楼内的一举一动,加上随时针对违反抗疫SOP一事开罚等,所有高楼的非法民宿将会逐日渐少,甚至可能有朝一日销声匿迹。

众筹买房被骗 上百人亏千万

别轻易被“高回酬”给骗了!

鼓励以众筹集资方式一起投资房地产,并将这些房屋通过爱彼迎(Airbnb)租出去,每年可获得36%的高回酬,还有保险公司和律师讲解,老千骗局“步步攻心”!

民主行动党直辖区投诉局主任游佳豪和副主任赖俊权,陪同5名受害者召开记者会,叙述自己惨痛的被骗经验。

据41岁的杨小姐说,他们是出席一家公司的众筹投资计划分享会,自称在吉隆坡和柔佛拥有房产来投资,通过爱彼迎短租来赚取收入,作为投资者的回酬。

这家公司的高层承诺,投资计划有保险保障,并曾邀请保险公司出席分享会,还委任律师制定合同,保障所有投资者获得回酬。

杨小姐出示公司从2016年起,每月举办的分享会都吸引百人出席,相信受害人数超乎想象。

惨亏50万 和亲友反目

她在2016年时投资了3.5万令吉签署第一份合同,随后连本带利获得回酬和本金,让她信心大增,还兼职做抽佣经纪介绍亲友加入。在2017至2018年期间,她签署了7份合同,投资数额高达50万令吉。

不过,该公司后来停止发回酬给投资者,她和7至8名受害人,曾于2019年和公司高层会面,当时对方要求他们签署不平等的和解协议,甚至带着数名印裔保安员陪同,惟因提出的协议不公,所以当场无人妥协和签署。

最后该公司倒闭,老板闹失踪,职员也被拖欠薪水,负责人原本使用的电话号码也全都无法联系。

受害者上百人

杨小姐说,现在回看当时签署的合同,当中没有阐述任何投资房产和运作模式的细节。如今父母的棺材本被骗,亲友们的血汗钱被骗走,她和大家反目并天天被追钱,苦不堪言。

她报警并向武吉阿曼商业罪案调查局一名警官求助,对方告知,公司提供36%的高回酬,不排除涉嫌骗局,建议所有受害者报案。

“为此,我开设群组建议受骗者们踊跃报案,并请他们提供编号,经统计后显示,受骗人数达上百人。”

员工全被欠薪 投资血本无归

另一名受害者刘先生是这诈骗公司的员工,他表示从事销售经纪职不超过一年,起初雇主如期发放佣金,后来无故拖欠薪水,最终宣告倒闭。

“当时,公司约有15名销售经纪和行政人员,全数被欠薪两个月,而我也有投资25万令吉,最终血本无归,因此我呼吁,若公众要加入任何投资计划,必须谨慎为上和做好功课,避免坠入骗局。”

游佳豪将协助受害人致函给武吉阿曼商业调查组,要求警方开档调查此案,以便将涉案者捉拿归案,同时也将会把相关文件提呈给国家银行,以便当局进一步展开彻查工作。

调查:8成人支持短租!

将公寓放上Airbnb平台短租,
你是支持派还是反对派?

过去有不少报道或社媒贴文,一些住户投诉邻居将公寓单位放上爱彼迎(Airbnb)的平台开放短租,担忧会带来治安等问题。

也常有一些公寓住户通过常年大会,禁止住户将公寓开放短租。

不过,爱彼迎最近的一项问卷调查,有点“颠覆”这印象。

该公司发出文告指出,有80%的受访者认为,应该开放国人将空置的公寓短租出去,来解决房地产过剩的问题,尤其是在槟城、柔佛、吉隆坡和雪兰莪等州。

调查结果也显示,有60%人的受访者支持他们所居住的城市居民,在爱彼迎平台上出租房屋,认为这其实能提振我国和当地社区。

超过三分之二的受访者认为,短租住宿能带动当地社区的经济增长;62%受访者认为,这不仅仅利好房东,也能激励当地的商业活动。

在旅游方面,超过一半的受访者指出,在国内旅游时会选择短租住宿。

爱彼迎东南亚区公共政策主管吴湘仪指出,这项调查时在去年12月23日至今年1月14日期间进行,访问了1020位大马人。

她指出,短租是我国经济的主要贡献者,许多人都相信这可带动当地社区,也有越来越多人考虑接受短租。
